REFERENCIA: Circular Informativa de fecha 28 de octubre de 2004.

ASUNTO: AJUSTES TEMPORALES DE TARIFAS

Respecto a nuestra circular de fecha 28 de octubre del 2004, nos permitimos informarles que a partir de la fecha y con efectos al 10 de noviembre del presente año, se sustituye dicha circular por el presente documento, debido a lo siguiente:

Hacemos de su conocimiento que Ferrocarril Mexicano, S.A. de C.V. (Ferromex) solicitó a la Secretaría de Comunicaciones y Transportes (SCT), el registro correspondiente al concepto de sobrecargo temporal de combustible, mientras el precio del Diesel no regrese a sus valores anteriores.

En respuesta a lo anterior, mediante oficio No. 120.204.-1941 de fecha 9 de noviembre del actual, la SCT negó a esta empresa dicho registro, argumentando que la normatividad en materia de transporte ferroviario no contempla la aplicación de sobrecargo alguno a la tarifa con carácter general, en cambio establece la libertad para fijar libremente las tarifas.

En este contexto, la propia SCT señala que de acuerdo con lo establecido en el artículo 170 del Reglamento del Servicio Ferroviario, las tarifas registradas por Ferromex son las máximas aplicables y a partir de ellas pudiera estructurar promociones y otorgar descuentos, considerando dicha Autoridad que un mecanismo que podría aplicar esta empresa, es la de modificar los descuentos que otorga en razón de la variación que se observe en el precio de los combustibles. Copia de esa comunicación la adjuntamos para su información (anexo 1).

Por lo anterior, Ferromex ha procedido a disminuir los descuentos a las tarifas que actualmente aplica a los usuarios, tomando como referencia los rangos previstos en la Tabla que se adjunta a la presente (anexo 2), en el entendido que la tarifa que aplicará en sus fletes, en ningún caso excederá la Tarifa registrada ante la SCT.

A partir de ésta fecha y para mayor claridad nuestras facturas mostrarán el monto del ajuste en el descuento aplicable en forma desglosada, con la leyenda: “Ajuste temporal en el descuento a la tarifa registrada ante la SCT”.

En espera de que lo anterior promueva una sana convivencia con nuestros clientes, y asimismo, genere certeza jurídica para ambas partes, confiando en contar con su comprensión y esperando que esta situación extraordinaria en los precios del petróleo regrese a la normalidad en breve, aprovechamos la ocasión para enviarles un cordial saludo.

AJUSTES TEMPORALES A LOS DESCUENTOS DE FERROMEX

Para compensar las fuertes variaciones que ha venido observando el precio de los combustibles, las cuales se traducen en mayores costos, se ajustarán los descuentos que se venían otorgando sobre el flete, conforme a los siguientes criterios;

a) Mientras el precio del Diesel surtido por Pemex LAB Irapuato (antes de IEPS e IVA en nuestro centro de abasto más importante) iguale o exceda los $2.50 M.N. por litro, se aplicará el ajuste a los descuentos a partir del primer día del mes siguiente. Dicho ajuste continuará durante los siguientes meses mientras el precio no descienda de los $2.50 M.N. por litro.

b) El Precio del Diesel de Pemex LAB Irapuato será publicado en nuestra página electrónica, para referencia y consulta de nuestros clientes. <www.ferromex.com.mx >

c) Durante los primeros 10 días del mes, se dará a conocer el precio que Ferromex paga por el Diesel de Pemex LAB Irapuato en el mes en curso, y será la base para determinar el porcentaje de ajuste del descuento por variación en el precio del combustible aplicable para el siguiente mes. Para iniciar la aplicación de este programa emergente se utilizará como referencia el precio del Diesel LAB Irapuato que se paga a Pemex durante este mes de octubre, que es de $ 4.006 M.N. por litro, y que equivale a un Ajuste del 5.5 % sobre las tarifas de fletes que tienen descuentos.

d) El incremento temporal resultante de los ajustes a los descuentos, se basará en la siguiente tabla:

Este cargo será aplicado en la factura en forma desglosada con la leyenda “Ajuste temporal en el descuento a la tarifa registrada ante la SCT”.

e) Cuando el precio Pemex LAB Irapuato disminuya por debajo de $2.50 M.N. por litro, el ajuste de los descuentos dejará de aplicarse

f) Dicho ajuste en los descuentos es de aplicación general tanto para tráficos locales como interlineales domésticos y extranjeros. El documentar cualquier carro a partir del 10 de noviembre implica la aceptación de esta medida emergente.

SUBJECT: TEMPORARY RATE ADJUSTMENT

In regard to our circular letter dated October 28, 2004, we would like to inform you that as of this date and effective November 10, 2004, the above mentioned circular letter is replaced by this one, due to the following:

We inform that Ferrocarril Mexicano, S.A. de C.V. (Ferromex) requested the Ministry of Communications and Transportation (SCT) to register a temporary fuel surcharge on rates while the price of diesel fuel remains above $ 2.50 M.N./liter.

In response, by official communication No. 120.204.-1941 dated November 9, 2004, the SCT refused registration, arguing that the regulatory provisions governing rail transport do not contemplate applying a surcharge to the general rates, but does provide that rates may be freely established.

Within this context, the SCT states that according to article 170 of the Regulations of the Railroad Service the rates Ferromex has registered are the maximum rates applicable, and may be discounted at the discretion of Ferromex to recover variation in the price of fuel. We attach copy of this communication for your information (Annex 1).

Consequently, Ferromex has lowered discounts in the rates currently applied to users, on the basis of the ranges set forth in the attached Table (Annex 2), with the understanding that the rate shall not exceed the Rate registered at the SCT.

Effective November 23, 2004, our invoices shall specify the amount of the adjustment to the applicable discount, identified as ”Temporary adjustment to the discount on the rate registered at the SCT”.

We hope this will continue to foster a sound relationship with our customers in addition to providing legal certainty for all parties involved. We trust we will have your understanding and hope that the extraordinary situation regarding oil prices soon returns to normal.

Annex 2

TEMPORARY ADJUSTMENTS TO DISCOUNTS

To compensate the strong fluctuations that have recently been felt in fuel prices, which translate into higher costs, the discounts on our freight rates will be adjusted according to the following criteria:

a) As long as the diesel supplied by PEMEX FOB Irapuato (before taxes, at our main fueling center) is equal to or greater than $2.50 Mex. Cy. per liter, an adjustment to discounts shall be applied as of the first day of the succeeding month. This adjustment shall remain in place for the following months as long as the price does not fall below $2.50 Mex. Cy. per liter.

b) The price of PEMEX diesel FOB Irapuato will be published in our web site, which may be viewed by our customers at. <www.ferromex.com.mx >

c) During the first 10 days of the month the price paid in that month by Ferromex for Pemex Diesel, FOB Irapuato will be published and will serve as the basis to determine the percentage by which the discount will be adjusted and applied in the following month. To start applying this emergency program, the initial reference price will be the price of diesel FOB Irapuato paid to Pemex in October 2004, that is, $4.006 Mex. Cy. per liter, resulting in an adjustment of 5.5% on the freight rates with discounts.

d) The temporary increase resulting from the adjustments to discounts will be as set forth in the following table:

This charge will be specified in the invoice and identified as “Temporary adjustment to the discount on the rate registered with the SCT”.

e) When the price of PEMEX diesel FOB Irapuato falls below $2.50 Me. Cy. per liter, the adjustment to discounts shall no longer be applied.

f) This is a general discount adjustment applicable to all local and inter-line domestic and international traffic. Any car documented as of November 10, 2004, implies acceptance of this emergency measure.
